La Galleria Milanese ha l'obiettivo principale di promuovere l'arte e aumentare la visibilità dell'Artista e delle sue opere per le vendite, nel panorama italiano e internazionale e lo sfruttamento commerciale delle immagini digitali delle opere d'arte attraverso il nostro sito web, accessibile su www.galleriamilanese.com (il "Sito") o applicazione mobile , incluse altre piattaforme pubblicitarie (facebook, instagram e TV) o siti partner. La Galleria Milanese cerca di promuovere una varietà di stili artistici (pittura, scultura, fotografia, disegno , illustrazioni) attraverso curatori specializzati. L'unico requisito per essere presenti è avere talento e una visione veramente artistica.

I presenti Termini, l'Informativa sulla privacy e qualsiasi altra politica qui collegata, regolano l'accesso e l'utilizzo dei Servizi e costituiscono un accordo legale vincolante tra l'artista partecipante e la Galleria Milanese.

1- Si presume che, includendo il lavoro sul sito GALLERIA MILANESE l'Artista esprima la sua intenzione e dichiari il diritto di venderlo oltre ad avere il lavoro per la consegna immediata.

2-L'artista deve fornire un imballaggio molto sicuro per il suo lavoro. La GALLERIA MILANESE non può essere ritenuta responsabile per i danni alle opere originali durante il trasporto. Consulta e segui le nostre linee guida contenute nel "ISTRUZIONI DI IMBALLAGGIO" su come imballare in modo sicuro per la spedizione.

3- DOPO LA ORDINE DI ACQUISTO

Dopo l'ordine di acquisto e il successivo pagamento da parte del cliente, entro un termine massimo di tre giorni è prevista la spedizione dell'opera (salvo condizioni avverse che impediscono tale procedura).

Se l'Opera non è più disponibile, verrà inviata un'e-mail di informazione dell'Acquirente entro il 48 ore, annullando l'ordine.

4-SPEDIZIONE DELL'OPERA

Vedi sotto per informazioni sui passaggi necessari affinché il tuo lavoro possa raggiungere il collezionista in sicurezza. Questi passaggi includono:

Pianificazione di una data per ritirare le opere d'arte vendute. La Galleria Milanese invierà tramite email la LETTERA DI VETTURA della raccolta dell'opera. La spedizione deve avvenire entro 2-3 giorni dalla data in cui il collezionista ha acquistato l'opera.

Leggi attentamente la sequenza che abbiamo preparato per assicurarti di sapere come imballare correttamente la tua arte di spedizione.

Tutte le opere originali vengono inviate al collezionista direttamente dall'artista.

La consegna delle Opere viene effettuata all'indirizzo indicato nel modulo riepilogario dell'ordine, durante l'orario lavorativo e secondo le modalità previste dal vettore scelto al momento dell'ordine.

Subito dopo la vendita dell'opera, Galleria Milanese invierà la Lettera di Vettura e l'artista dovrà stamparla e incollarla sul pacco.

- In ambito NAZIONALE (in tutta Italia) la spedizione è gratuita, pertanto il costo di spedizione deve essere preventivamente aggiunto al prezzo dell'opera da pubblicare per la vendita. In altre parole, nel prezzo dell'opera presente sul sito è già compreso il costo di spedizione nell'Italia.

- A livello INTERNAZIONALE , il cliente pagherà il costo di spedizione. Il cliente potrà scegliere il corriere di sua scelta (elencata sul sito) in quanto pagherà le spese di spedizione. Sarà da lui pagata al momento dell'acquisto dell'opera.

In entrambi i casi se il destinatario non è all'indirizzo per ricevere l'opera, questa deve essere ritirata dal magazzino del corriere entro 3 giorni dal primo tentativo e se non viene ritirata entro questo termine, l'utente deve pagare le spese di restituzione.

Tu, l'artista, sarai responsabile dell'imballaggio della tua arte per la spedizione, nonché di tutti i costi di imballaggio.

5-CERTIFICATO DI AUTENTICITÀ

Quando prepari il tuo lavoro per la spedizione, devi includere un CERTIFICATO DI AUTENTICITÀ all'interno della confezione da inviare al collezionista che ha acquistato l'opera. Il Certificato di Autenticità ti verrà inviato, tramite posta elettronica, dalla Galleria Milanese. Si stampa, si firma e si invia insieme al lavoro.

Si prega di notare che il tempo di transito può variare a seconda della posizione del cliente. Vedrai il numero di tracciamento della tua spedizione sull'etichetta fornita dalla compagnia di spedizione . È possibile tenere traccia utilizzando questo numero di tracciamento direttamente sul sito Web del corriere.

6-PAGAMENTO

Al momento dell'acquisto, il cliente pagherà sul sito della Galleria Milanese ed entro un termine massimo di 30 giorni l'artista riceverà il pagamento, al netto di una commissione del 20 % (dieci per cento) del valore dell'opera.

7-POLITICA DI RESI E RIMBORSO

OPERE ORIGINALI

LA GALLERIA MILANESE si impegna a garantire il 100% di soddisfazione dai nostri collezionisti d'arte! Ecco perché, la politica resi della Galleria Milanese ti consente di restituire l'articolo acquistato. Dopo aver ricevuto un'opera d'arte originale, ti daremo sette (7) giorni per decidere se desideri o meno conservare l'opera d'arte o restituirla per un rimborso.

È possibile restituire qualsiasi opera d'arte idonea , purché venga restituita all'artista nelle sue condizioni e confezione originali.

Se ricevi il prodotto e rinunci all'acquisto, hai la possibilità di restituirlo entro 7 giorni di calendario dalla ricezione dell'ordine, con il rimborso del 100% del valore dell'opera in questione.

La restituzione è consentita :

1- Se l'opera è diversa da quella acquistata dal cliente.

2-Se il lavoro è danneggiato.

* Non saranno accettati prodotti la cui imballaggio è stata aperta e rifatta.

* Non saranno accettati prodotti senza certificato di originalità in perfette condizioni.

* Non saranno accettati prodotti con imballo protettivo danneggiato o inutilizzabili o con indicazioni per l'uso.

* Non saranno accettati cambi di prodotti acquistati tramite promozioni o buoni / buoni sconto come parte del pagamento.

Come restituisco un'opera originale?

Dal momento in cui ricevi la tua opera d'arte originale dai nostri corrieri, hai sette (7) giorni per o restituire l'opera nelle sue condizioni originali per un rimborso.

Richiediamo inoltre che la opera restituita venga spedita dall'acquirente entro tre (3) giorni dalla conferma della restituzione dell'opera. Quindi, se ricevi un'opera d'arte che hai acquistato da Galleria Milanese e non sei completamente soddisfatto, hai:

Tre (3) giorni per contattarci in merito alla tua intenzione di restituire la opera.
Tre (3) giorni dal giorno in cui ci hai contattato per spedire l'opera d'arte. Non spedire l'opera prima di contattarci; devi prima contattarci.

Se non ci comunichi la tua intenzione di restituire il lavoro entro 3 giorni dal ricevimento o non spedisci il lavoro entro 3 giorni dalla notifica, non avrai diritto a un rimborso. (Si applicano alcune eccezioni. Contattaci per una valutazione della tua situazione specifica.) GALLERIA MILANESE si riserva il diritto di decidere a sua esclusiva discrezione.

Cosa fare se l'opera d'arte arriva danneggiata

- Entro tre (3) giorni dalla data di consegna della merce, inviare un'e-mail a info@galleriamilanese.com per comunicarci Informazioni sull'ordine. Scatta foto di immagini e imballaggi danneggiati. Invia queste foto via e-mail a info@galleriamilanese.com. Salva l'imballaggio originale.

Un rappresentante della Galleria Milanese ti contatterà per aiutarti nei passaggi successivi.

GALLERIA MILANESE non potrà in nessun caso essere ritenuta responsabile per il mancato rispetto dall'Acquirente, che ha il diritto di presentare un reclamo contro il fornitore di servizi di consegna. L'Acquirente deve, non appena riceve l'ordine, verificare le condizioni dell'opera d'arte, e menzionare immediatamente e per iscritto , a GALLERIA MILANESE, che trasferirà al Corriere.

8-Le opere in pubblicazione nel sito non sono in esclusiva. Le opere possono essere pubblicati su altri portali ed essere in esposizione per la vendita in qualsiasi galleria fisica. Nel momento in cui l'opera viene venduta dall'artista e non attraverso questo sito web, in tal caso l'artista si impegna di informare immediatamente Galleria Milanese, al fine di escludere l'opera dal sito web.

9-Le opere durante il periodo di pubblicazione sul sito, rimangono “a casa” del pittore che può disporre delle stesse per eventuali attività espositive.

10-L'Artista si impegna a comunicare l'aggiornamento dei dati inseriti nella sua registrazione ("Dati personali" o altri) quando necessário.

11-L'Artista autorizza la pubblicazione e la diffusione delle sue opere ( pittura, scultura, fotografia, disegno , illustrazioni ) sul sito GALLERIA MILANESE, su internet, TV, sito partner e su altri social media, cataloghi, riviste e giornali, con il solo scopo di promuovere la vendita e dare visibilità all'Artista.

12-L'artista garantisce, assumendo tutte le relative responsabilità, di essere il proprietario esclusivo dei diritti di esplorare e sfruttare economicamente delle opere visualizzate sulla sua pagina sul sito GALLERIA MILANESE, esentando il sito da qualsiasi responsabilità al riguardo. Si impegna a proteggere la GALLERIA MILANESE e l'Acquirente in caso di qualsiasi azione intentata da un terzo parte sull'opera ceduta, come parte della garanzia di possesso silenzioso. Al momento della vendita, il Venditore assegna all'Acquirente il substrato materiale dell'opera d'arte e il suo diritti di rappresentazione sull'opera d'arte. Il Venditore conserva tuttavia il proprio diritto morale sull'opera d'arte nonché i diritti in materia di la sua riproduzione.

13-L'artista potrà in ogni momento cancellare la propria iscrizione e recedere senza alcuna penalità o multa, purché siano concluse le operazioni di vendita in corso.

14-Dal momento in cui l'Artista pubblica su questo sito o il cliente accede ai servizi, accetta tacitamente tutti i Termini e le Condizioni di funzionamento.

L'accettazione incondizionata di integrali condizioni generali di vendita è obbligatoria per concludere il contratto di vendita, sia da parte del Venditore che dell'Acquirente. L'accettazione è confermata da una casella che deve essere selezionata nel modulo d'ordine dell'opera d'arte.

15-GALLERIA MILANESE si riserva il diritto, a sua esclusiva discrezione, di modificare, interrompere o terminare i Servizi o di modificare i presenti Termini, in qualsiasi momento . Se modifichiamo i presenti Termini, pubblicheremo la modifica sui Servizi o ti informeremo della modifica. Aggiorneremo anche la "Data ultimo aggiornamento". Continuando ad accedere o utilizzare i Servizi dopo che abbiamo pubblicato una modifica sui Servizi o ti abbiamo fornito un avviso di modifica, stai indicando di accettare di essere vincolato dai Termini modificati. Se i Termini modificati non sono accettabili per te, l'unica possibilità è cessare di utilizzare i Servizi. Ti invitiamo a controllare regolarmente per rivedere questi Termini e Condizioni.

16– FORZA MAGGIORE In caso di situazione di forza maggiore, l'esecuzione del contratto può essere sospesa o, se è completato, causare l'annullamento della vendita. Espressamente, sono considerati casi di forza maggiore o eventi fortuiti, quelli solitamente riconosciuto dalla giurisprudenza delle corti e dei tribunali , vale a.d. un evento che è fuori dal controllo del debitore, che non poteva essere ragionevolmente previsto all'epoca del contratto in fase di concluso e i cui effetti non possono essere evitati da alcuna Misure. La parte che invoca la Forza Maggiore deve informare immediatamente l'altra parte, nonché su la sua estinzione.

The Milanese Gallery has the main objective of promoting art and increasing the visibility of the Artist and his works for sales, in the Italian and international panorama and the commercial exploitation of digital images of works of art through our website, accessible on www.galleriamilanese.com (the "Site") or mobile application, including other advertising platforms (facebook, instagram and TV) or partner sites. The Galleria Milanese seeks to promote a variety of artistic styles (painting, sculpture, photography, drawing, illustrations) through specialized curators. The only requirement to be present is to have talent and a truly artistic vision.

We recommend that you carefully read the following Terms and Conditions and our Privacy Policy, which can be found at www.galleriamilanese.com Privacy Police. These Terms, the Privacy Policy and any other policies linked herein, govern your access to and use of the Services and constitute a binding legal agreement between you and Galleria Milanese.

1- It is assumed that, by including the work on the GALLERIA MILANESE website, the Artist expresses his intention and declares the right to sell it in addition to having the work for immediate delivery.

2-The artist must provide very safe packaging for his work. Galleria MILANESE cannot be held responsible for damage to the original works during transport. Consult and follow our guidelines contained in the "PACKAGING INSTRUCTIONS" on how to pack safely for shipping.

3- AFTER THE PURCHASE ORDER

After the purchase order and the subsequent payment by the customer, within a maximum period of three days the work is expected to be shipped (except for adverse conditions that prevent this procedure). If the Work is no longer available, an email informing the Buyer will be sent within 48 hours, canceling the order.

4-SHIPMENT OF THE WORK

See below for information on the steps required for your work to reach the collector safely. These steps include:

The Milanese Gallery will send by email the WAYBILL (documents for dispatch) of the collection of the work. The shipment must take place within 2-3 days from the date on which the collector purchased the work.

The delivery of the Works is carried out at the address indicated in the order summary form, during working hours and in the manner prescribed by the carrier chosen at the time of the order.

All original works are sent to the collector directly from the artist’s studio.

Immediately after the sale of the work, Galleria Milanese will send the Waybill (documents for dispatch) and the artist must print it and paste it on the package.

- In the NATIONAL area (throughout Italy) shipping is free, therefore the shipping cost must be previously added to the price of the work to be published for sale. In other words, the price of the work on the site is already included inthe cost of shipping in Italy.

- Internationally, the customer will pay the shipping cost. The customer can choose the courier of his choice (listed on the site) as he will pay the shipping costs. Itwill be paid by him at the time of purchase of the work.

In both cases, if the recipient is not at the address to receive the work, he must withdraw it from the carrier's deposit within 3 days after the first attempt and if it is not withdrawn within that period, he must pay the return costs.

You, the artist, will be responsible for packaging your art for shipping, as well as all packaging costs.

5-CERTIFICATE OF AUTHENTICITY

When preparing your work for shipment, you must include a CERTIFICATE OF AUTHENTICITY inside the package to be sent to the collector who purchased the work. The Certificate of Authenticity will be sent to you, by e-mail, from the Milanese Gallery. You print, sign and send along with the work.

Please note that transit time may vary depending on the customer's location. You will see the tracking number of your shipment on the label provided by the shipping company. You can track using this tracking number directly on the carrier's website (e.g. BRT, FedEx, DHL, UPS, etc.).

6-PAYMENT

At the time of purchase, the customer will pay on the Website of the Milanese Gallery and within a maximum period of 30 days the artist will receive the payment, net of a commission of 10%(ten percent) of the value of the work.

7-RETURN AND REFUND POLICY

LA GALLERIA MILANESE is committed to guaranteeing 100% satisfaction from our art collectors! That's why, Galleria Milanese's returns policy allows you to return the purchased item. After receiving an original artwork, we will give you seven (7) days to decide whether or not you wish to keep the artwork or return it for a refund.

You can return any eligible artwork, as long as it is returned to the artist in its original condition and packaging.

If you receive the product and renounce the purchase, you have the option to return it within 7 calendar days of receipt of the order, with a refund of 100% of the value of the work in question.

The return is allowed :

1- If the work is different from the one purchased by the customer.

2-If the work is damaged.

* Products whose packaging has been opened and redone will not be accepted.

* Products without certificate of originality in perfect condition will not be accepted.

* Products with damaged or unusable protective packaging or with indications for use will not be accepted.

* Exchanges of products purchased through promotions or discount coupons /vouchers will not be accepted

How do I return an original work?

From the moment you receive your original artwork from our couriers, you have seven (7) days to or return the work in its original condition for a refund.

We also require that the returned work be shipped by the buyer within three (3) days of confirmation of the return of the work. So, if you receive a work of art that you purchased from Galleria Milanese and you are not completely satisfied, you have:

Three (3) days to contact us regarding your intention to return the work.

Three (3) days from the day you contacted us to ship the artwork. Do not send the work before contacting us; you must first contact us.

If you do not notify us of your intention to return the work within 3 days of receipt or do not ship the work within 3 days of notification, you will not be entitled to a refund. (Some exceptions apply. Contact us for an assessment of your specific situation.)

What to do if the artwork arrives damaged

- Within seven (3) days from the date of delivery of the goods, send an e-mail to info@galleriamilanese.com to communicate information to us about the order. Take photos of damaged images and packaging. Email these photos to info@galleriamilanese.com. Save the original packaging.

A representative of the Milanese Gallery will contact you to help you in the next steps.

8-The works published on the site are not exclusive. The works can be published on other portals and be on display for sale in any physical gallery. When the work is sold by the artist and not through this website, in this case the artist undertakes to immediately inform Galleria Milanese, in order to exclude the work from the website.

9-The works during the period of publication on the site, remain "at home" of the painter who can dispose of the same for any exhibition activities.

10-The Artist undertakes to communicate the updating of the data entered in his registration ("Personal Data" or others).

Art. 11-The Artist authorizes the publication and dissemination of his works (painting, sculpture, photography, drawing, illustrations) on the GALLERIA MILANESE website, on the internet, TV, partner site and on other social media, with the sole purpose of promoting the sale and giving visibility to the Artist.

12-The artist guarantees, assuming all the related responsibilities, to be the exclusive owner of the rights to explore and economically exploit the works displayed on his page on the GALLERIA MILANESE website, exempting the site from any liability in this regard. It undertakes to protect the GALLERIA MILANESE and the Buyer in the event of any action brought by a third party on the transferred work, as part of the guarantee of silent possession. At the time of sale, the Seller assigns to the Buyer the material substrate of the artwork and its representation rights over the artwork. However, the Seller retains its moral right over the work of art as well as the rights regarding its reproduction.

13-The artist may at any time cancel his registration and withdraw without any penalty or fine, provided that the sales operations in progress are concluded.

14-From the moment the Artist publishes on this site or the customer accesses the services, he tacitly accepts all the Terms and Conditions of Operation. The unconditional acceptance of the full general conditions of sale is mandatory to conclude the sales contract, by both the Seller and the Buyer. Acceptance is confirmed by a box that must be checked in the order form of the work of art.

15-GALLERIA MILANESE reserves the right, in its sole discretion, to modify, discontinue or terminate the Services or to modify these Terms, at any time. If we change these Terms, we will post the change on the Services or notify you of the change. We will also update the "Last Updated Date". By continuing to access or use the Services after we have posted a change on the Services or provided you with a change notice, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only option is to cease using the Services. We encourage you to check back regularly to review these Terms and Conditions.

16– FORCE MAJEURE In the event of a situation of force majeure, the execution of the contract may be suspended or, if completed, lead to the cancellation of the sale. Expressly, cases of force majeure or fortuitous events are considered, those usually recognized by the jurisprudence of the courts and tribunals, ie a.d. an event which is beyond the control of the debtor, which could not reasonably have been foreseen at the time of the contract being concluded and the effects of which cannot be avoided by any Measures.
